This is a privacy policy and cookies policy (the “Privacy Policy”) for the mobile app and website (the mobile app, this site and any applications or other software provided by Mercova, LLC, for use with the site or otherwise, collectively, the “Site”).  Mixie,  operated by Mercova, LLC (“us,” “we,” or “Mixie”) provides a service through its Site. 


Mixie is an invite-only lifestyle app that connects its members with a curated choice of nearby local bars and restaurants, featuring selections from the city’s top chefs, where they are rewarded with 1 complimentary welcome drink or appetizer on every visit. Mixie is an invite-only network, which means that the only way to gain access is by getting an invitation from existing members. We use personal information to provide our services, to communicate about existing and new Mixie features with you, and to comply with our Terms of Use Agreement and applicable laws. We do not sell personal information.


This Privacy Policy is part of the Terms and Conditions for users that create a Mixie account.   By using the Site you consent to the collection and use of your personal information in accordance with this Privacy Policy. If you do not agree with the use of your personal information as set forth in this Privacy Policy, or the Terms of Use Agreement, please do not use this Site and delete your Mixie account. 


We may make changes to this Privacy Policy from time to time. We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, or changes in business practices. Unless otherwise specified, any changes or modifications will be effective immediately upon posting of the revisions on the Site. The most recent version of this Agreement is the version that is effective. We will notify you in advance of the changes by reasonable means, which could include notification through the Site or via email. If you continue to use the Site after the changes become effective, then you agree to the revised Privacy Policy. If you do not delete your Mixie account you will be deemed to have accepted the revised Privacy Policy. 


Collection of Personal Information


We collect personal information (“Personal Information”) that you provide to us when creating a Mixie account or by using the Site. 


Personal Information we may collect includes, but is not limited to:


  • Account information, including name, last name, email address, telephone number, profile picture, user name, age, date of birth and other information.
  • Your contacts’ phone numbers (if you choose to authorize this). To help users invite people they know into our invite-only app, users are offered the option to invite other members to join Mixie. You will be able to share phone numbers from your address book or add the phone numbers manually if you choose to do so.
  • Names of friends you choose to invite to join you on the Mixie app.
  • We may also automatically collect commonly logged user-to-server information such as device data, device internet protocol (IP) address (and derived location), browser, device type and operating system type, and information about the pages you visit on our Site, including the date and time of use of the Mixie app, interactions with the Mixie app, and the time, frequency, and duration of the interactions. If you're using our Site through the a mobile device, we use mobile device IDs (the unique identifier assigned to a device by the manufacturer), or Advertising IDs (for iOS 6 and later), instead of cookies, to recognize you.  Advertising IDs can be reset in “Settings” on your iPhone. Marketing companies also use device IDs or Advertising IDs to track your use of the Site, track the number of ads displayed, measure ad performance and display ads that are more relevant to you. Analytics companies use device IDs to track information about app usage.
  • Social Media companies. We also collect Personal Information from social media companies and from your Facebook login, Google login or email if you access the Site or sign in using your Facebook login, Google login or email, including but not limited to your public Facebook and Google profile and information about Facebook friends and Google contacts you share in common with other Mixie users, your personal information and any other information you have on Facebook and Google. 

Personal Information includes your friends or contact lists that you may provide to us by connecting your Mixie account with your mobile device, or other third-party social network accounts.  We may also collect Personal Information about you when you interact with us on other social media sites. The Personal Information we obtain from you may include name, email address, phone number, gender, date of birth, zip code, location, business patronage preferences, annual income, age, ethnic origin, nationality, religion and/or sexual orientation ethnicity and/or race and other demographic information.

We may use cookies, logging, tracking or similar technologies.  If you disable technologies such as cookies through your web browser, it may impair your ability to access and use our Sites and the service.


We do not respond to web browser “do not track” signals.


Use of Personal Information


The Personal Information we collect from you is used to operate the Site and provide a service to you.  We may use that Personal Information where in our legitimate interest to do so for the following purposes:


  • to invite you and your friends referred by you to Mixie
  • to create and maintain your account
  • to contact you and respond to your questions and enquiries
  • to provide the service through the Site
  • to carry out, monitor and analyze our business or website operations
  • to manage your account with Mixie
  • verify transactions in relation to online payments
  • carry out research on our users’ demographics and tracking the use of the service
  • to provide marketing services to third party partner venues (the “Venues”) including without limitation giving access to your Personal Information through the online partner dashboard partner dashboard (the “Partner Dashboard”) which is an advanced data analytics and marketing software on the Site available for our Venues
  • to provide marketing materials from our partner venues and other venues in the Mixie app
  • to send you information about our products and services or those of third parties, provided you have consented to being contacted for these purposes
  • to carry out, operate, monitor and analyze our business
  • to facilitate network connections
  • to comply with applicable laws


Sharing of Personal Information


In addition to the above, we share information, including Personal Information, with any of our affiliates, agents, contractors, advisors, Venues, professional advisors, authorities and in general to third party service providers and other persons with whom we have contracted with in order for them to perform the functions for which we have contracted with them, including without limitation marketing, promotion, data analytics, system design and maintenance.  We may disclose aggregate statistics about visitors to the Site, users of the Site, customers and sales in order to describe our services to prospective Venues, partners, advertisers, sponsors and other third parties and for other lawful purposes.  We may also share information, including Personal Information, with prospective investors, lenders or third parties that are looking to invest or participate in our business, including in connection with an issuance of equity in Mixie, merger, consolidation, acquisition, reorganization, financing transaction, sale or similar transactions.


We may also share Personal Information with third parties to (a) comply with applicable laws, legal process or orders from a court, (b) protect the rights and property of Mixie, our agents, members, and others including to enforce our agreements, policies, venue terms and conditions and terms of use agreement; or (c) in connection with any proposed financing, proposed investment, or merger, sale of all or substantially all of our assets or equity interests.  In any such event, we will provide you with notice that your Personal Information is being transferred.  




As part of our service, you have the option to refer us and the Site to other people or similar initiatives.  You confirm that you have the permission of such persons to provide such information and contact details.  We also reserve the right to identify you as the person who made the referral through your referral code.


Third-party websites


This Privacy Policy only relates to the use of your Personal Information in our Site and our service.  If you click an advertising or other link that gives you access to another site you will be subject to such other person collection and use of information policies.  You should consult such third party privacy policy for the use of your information by such person.

If you wish to opt-out of receiving future promotional communications, you may do so by following the unsubscribe instructions included in such emails, or by contacting us at


Change Your information


You can update, review, correct and change your Personal Information through your mobile device and visiting your account profile page.  You can also opt out of marketing communications and push notifications. If you opt-in to receive push notifications within the Site, we may send push notifications or alerts to your mobile device from time to time. You can deactivate push notifications and alerts at any time by changing your device settings, changing the push notification settings within the Mixie app, or deleting the Mixie app. You may send us an email at to request access to, correct, or delete any personal information that you have provided to us or to opt out of any communication from Mixie.  We will respond to requests within the time allowed by all applicable privacy laws and will make every effort to respond as accurately and completely as possible. We cannot delete your Personal Information except by also deleting your user account.


Security and Retention


We may retain information provided by you, including Personal Information, for as long as necessary to comply with our legal obligations, or to achieve the purposes for which the information was originally collected and for the purposes described in this Privacy Policy and in our applicable policies.


We maintain reasonable and appropriate, albeit not infallible, physical, electronic and procedural safeguards intended to maintain the confidentiality of Personal Information, including that provided by a visitor or users of the Site and provided while using other Internet Services. We do not guarantee that our safeguards will always work.

Information you provide about yourself while using our Service


We provide areas on our Service where you can post information about yourself and others and communicate with others. Such postings are governed by our Terms of Use Agreement. Also, whenever you voluntarily disclose personal information on publicly-viewable pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. Except as required by a court order or other similar legal proceeding, we will only make messages you send to another user through our Service accessible on the Service, unless you expressly request a copy of your messages in accordance with applicable law. Should you wish to receive a copy of any messages you received from other users through our Service, you must first obtain their prior written consent and then they must contact an officer of Mixie to provide their prior written consent.




We restrict the use of our service to individuals age 21 and above. We do not knowingly collect, maintain, or use personal information from children under the age of 21.
